Encountered LEP Groups:
A significant number or percentage of
the population eligible to receive services, or likely to be directly
affected by the covered entity’s (ADHS) programs who need services or
information in a language other than English to communicate
effectively. All vital materials shall be translated when a language is
spoken by 1,000 or 5% (whichever is less) of members who have LEP in
that language. Vital materials include, at a minimum, notices for
denials, reductions, suspensions or terminations of services, and
consent forms. All materials shall be translated when a language is
spoken by 3,000 or 10% (whichever is less) of members who have LEP.
